This Privacy Policy applies to Personal Information collected by ProCAT through:

  • “Licensed Client” means a Customer authorized by ProCAT to use specified ProCAT software, Products, Services, or customer resources pursuant to an applicable software license, purchase agreement, support agreement, maintenance arrangement, or other authorization issued by ProCAT.
  • “MyProCAT.com” or “MyProCAT” means ProCAT’s restricted customer resource website or portal through which authorized Licensed Clients may obtain software, software updates, upgrades, installations, firmware, drivers, utilities, documentation, technical information, training materials, support resources, and other materials made available by ProCAT.
  • “MyProCAT Resources” means software, software updates, upgrades, installations, firmware, drivers, utilities, documentation, technical materials, training materials, support resources, and any other proprietary, copyrighted, confidential, restricted, or licensed materials made available through MyProCAT.com.

4. Information We Collect

The categories of information ProCAT collects depend upon the nature of your relationship with us.

You may opt out of promotional communications at any time by following the unsubscribe instructions included in those communications or by contacting ProCAT directly.

5. Information We Do Not Intentionally Collect

ProCAT does not knowingly collect Personal Information from children under the age of thirteen (13) through its Websites.

We also request that Customers refrain from submitting sensitive personal information that is unrelated to their business relationship with ProCAT unless specifically requested or required to fulfill a legal or contractual obligation.

Customers are responsible for ensuring that the information provided to ProCAT is accurate, current, and complete.

ProCAT relies upon the accuracy of customer-provided information to administer warranties, software licenses, MyProCAT access, technical support, transactions, and customer records.

Customers may request corrections or updates to their Personal Information by contacting ProCAT using the contact information provided at the end of this Privacy Policy.

7. How We Use Personal Information

ProCAT uses Personal Information for legitimate business purposes consistent with this Privacy Policy and applicable law. The information we collect enables us to provide Products and Services, maintain customer relationships, administer software licenses and restricted customer resources, protect our business interests, and improve the quality of our Products and Services.

Depending upon your relationship with ProCAT, Personal Information may be used to:

  • Verify software licenses and warranty eligibility;
  • Verify eligibility for MyProCAT.com access;

Product registration does not expand or modify any warranty rights. Warranty coverage is governed solely by the applicable written warranty provided with the Product.

ProCAT develops proprietary software, firmware, drivers, documentation, and related technology protected by United States copyright law, trademark law, trade secret law, contractual restrictions, and other applicable intellectual property laws.

To administer software licenses and protect our intellectual property, ProCAT may maintain records relating to:

  • Customer accounts;
  • Product ownership;
  • Software version history;
  • Download dates;
  • Download history;
  • Product registrations;
  • License verification;
  • MyProCAT access;
  • MyProCAT account activity; and
  • Technical support or maintenance eligibility.

These records assist ProCAT in:

  • Administering software licenses;
  • Providing customer support;
  • Determining eligibility for software updates and other resources;
  • Verifying authorized use;
  • Preventing unauthorized distribution;
  • Investigating suspected software piracy or license violations;
  • Maintaining Product compatibility; and

Certain software, updates, documentation, and other licensed resources may be made available to eligible Licensed Clients through MyProCAT.com. Access to and use of MyProCAT.com and all materials obtained through it are subject to the restrictions described in Section 10 below and to all applicable ProCAT software licensing terms.

Nothing in this Privacy Policy grants any ownership rights in ProCAT software or modifies, enlarges, replaces, or supersedes the terms of any applicable software license agreement, purchase agreement, support agreement, maintenance agreement, or Computer Software Licensing Policy.

10. MyProCAT.com Access and Licensed Resources

MyProCAT.com is a restricted customer resource website provided by Advanced Translations Technology, Inc. (DBA ProCAT) for the exclusive use of eligible Licensed Clients.

Access to MyProCAT.com, including any username, password, account credentials, download privileges, or other access rights provided by ProCAT, is issued solely for the use of the Licensed Client to whom such access has been granted and is not transferable.

Exclusive Use of MyProCAT Resources

Resources made available through MyProCAT.com may include:

  • ProCAT software;
  • Software updates;
  • Software upgrades;
  • Full software installations;
  • Firmware;
  • Drivers;
  • Utilities;
  • Documentation;
  • Technical materials;
  • Training materials;
  • Support resources; and
  • Other proprietary or licensed materials.

Collectively, these materials constitute “MyProCAT Resources.”

MyProCAT Resources are provided exclusively for the authorized use of the Licensed Client for whom those resources are made available.

Unless expressly authorized in writing by ProCAT or expressly permitted under the applicable ProCAT license agreement, a Licensed Client may not share, transfer, disclose, publish, distribute, reproduce, sublicense, provide access to, or otherwise make available his or her MyProCAT.com account credentials or any MyProCAT Resources to another individual, business, organization, customer, court reporter, scopist, employee, contractor, or other third party.

Prohibition Against Sharing Software and Updates

Software, software updates, upgrades, installations, firmware, drivers, utilities, or other software-related materials obtained through MyProCAT.com are licensed materials.

The unauthorized copying, transfer, sharing, publication, distribution, or provision of any such materials to another user or third party is strictly prohibited.

A Customer may not download a ProCAT software update or other MyProCAT Resource for the purpose of installing, transferring, or providing it to another person or entity that is not independently authorized to receive and use that resource under an applicable ProCAT license or other written authorization.

Software Licensing Terms Continue to Apply

All ProCAT software and software-related materials accessed or downloaded through MyProCAT.com remain subject to the terms and conditions of the applicable:

  • ProCAT Purchase Agreement;
  • Single-User Software License Agreement;
  • Computer Software Licensing Policy;
  • Support or maintenance agreement; and
  • Any other applicable written software licensing terms issued by ProCAT.

Accessing or downloading software, an update, an upgrade, or any other software-related material through MyProCAT.com does not:

  • Transfer ownership of the software;
  • Expand the scope of an existing license;
  • Create an additional software license;
  • Authorize use on additional computers or devices beyond what the applicable license permits;
  • Authorize installation or use by another individual or organization; or
  • Authorize redistribution of the downloaded material.

All rights not expressly granted under the applicable software license remain reserved by ProCAT.

Account Credentials and Account Security

Licensed Clients are responsible for maintaining the confidentiality and security of their MyProCAT.com usernames, passwords, and other account credentials.

Customers may not permit another unauthorized person to use their MyProCAT credentials to obtain software, updates, documentation, technical resources, or other restricted materials.

Licensed Clients are responsible for activity conducted through their accounts to the extent permitted by applicable law and should promptly notify ProCAT if they know or reasonably suspect that:

  • Account credentials have been compromised;
  • An unauthorized person has accessed the account;
  • Software or other MyProCAT Resources have been downloaded without authorization; or
  • MyProCAT Resources have been copied, transferred, or distributed without authorization.

Verification and Enforcement

ProCAT reserves the right, consistent with applicable law and contractual obligations, to verify:

  • Customer identity;
  • Product ownership;
  • Software license status;
  • Product registration;
  • Support or maintenance eligibility;
  • Download eligibility; and
  • Authorized use of MyProCAT Resources.

Where ProCAT reasonably believes that an account, account credential, software product, software update, or other MyProCAT Resource has been shared, transferred, distributed, copied, or otherwise used in violation of an applicable software license, agreement, or ProCAT policy, ProCAT may investigate the activity and may restrict, suspend, or terminate access to MyProCAT.com or specific resources as appropriate.

Nothing in this Section limits any other contractual, statutory, equitable, or intellectual-property right or remedy available to ProCAT.

11. Technical Support

Providing effective technical support requires ProCAT to maintain accurate service records.

When Customers request assistance, ProCAT may use available information to:

  • Verify Product ownership;
  • Confirm warranty, license, support, or maintenance eligibility;
  • Confirm eligibility for applicable MyProCAT Resources;
  • Review previous service history;
  • Diagnose reported issues;
  • Recommend solutions;
  • Document resolutions;
  • Improve future support; and
  • Train customer service personnel.

Support communications, including email correspondence and telephone conversations, may be documented for quality assurance, training, security, and recordkeeping purposes where permitted by applicable law.

12. Customer Communications

ProCAT communicates with Customers for a variety of business purposes.

Examples include communications regarding:

  • Order confirmations;
  • Shipping notifications;
  • Product registrations;
  • Warranty matters;
  • Technical support;
  • Software availability;
  • Software updates;
  • MyProCAT account administration;
  • Product documentation;
  • Security notifications;
  • Account administration; and
  • Customer service.

These communications are considered part of the normal administration of your relationship with ProCAT and may be sent even if you have elected not to receive promotional communications.

13. Marketing Communications

With your consent where required by law, ProCAT may send newsletters, educational materials, product announcements, training opportunities, special promotions, and other marketing communications.

Marketing communications may be based upon:

  • Previous purchases;
  • Registered Products;
  • Customer preferences;
  • Training registrations;

  • Other interactions with ProCAT.

Customers may discontinue promotional communications at any time by using the unsubscribe instructions included in those communications or by contacting ProCAT directly.

Choosing not to receive promotional communications will not affect transactional or service-related communications necessary to administer your account or provide requested Products or Services.

29. Governing Law

This Privacy Policy shall be governed by and interpreted in accordance with the laws of the State of California and applicable federal law, without regard to conflict-of-law principles.

If any provision of this Privacy Policy conflicts with an applicable written software license or other contractual agreement concerning the ownership, licensing, installation, copying, transfer, distribution, or authorized use of ProCAT software or proprietary materials, the applicable written license or agreement shall govern those matters.

32. Effective Date and Entire Privacy Policy

This Privacy Policy is effective as of August 9, 2026 and supersedes previous versions of the ProCAT Privacy Policy upon its publication by ProCAT.

This Privacy Policy constitutes ProCAT’s complete statement regarding the collection, use, disclosure, retention, and protection of Personal Information obtained through ProCAT Websites and ProCAT’s business operations.

Where another written agreement expressly governs the handling of specific information relating to a particular Product, Service, license, or transaction, the terms of that agreement shall control with respect to the matters it specifically addresses.
